I have been using the Cannon trial date (and Cannon topics more broadly) to identify which news and news-like outlets are trying to actually inform me, and which ones are looking for my rage-clicks, so that I can quit the latter cold-turkey. Is this a sensible high-level heuristic?
I appreciate your analysis of the delays in many of Trump's trials and how that reflects upon the judiciary and I agree with a lot of what you've said.
However I can't help but feel that "the wheels of justice turn slowly" doesn't necessarily absolve the judicial branch from political timelines. If a president can commit crimes while in office and it takes more than four years to prosecute and convict such a president so they have an opportunity to be reelected and pardon or dismiss the charges against themselves, then isn't that a failure of the judicial system to hold our leaders to account?
Even when there are legitimate delays or real executive privileges, if our judicial system is not able to move fast enough to overcome those barriers before such leaders regain power, then is it really a system where no one is above the law? Shouldn't we be upset about this and demand change, whether that's politically relevant trials moving faster, fewer privileges for the executive branch, or any other remedy?
I realize this is almost a governmental or poly sci question rather than a legal one, but I would very much appreciate your thoughts. Thank you for running this podcast, always interesting to listen to.
My brain just stopped at the phrase "Certified Pedophile" . Think of the fun lawyers could have questioning the validity of that statement. How does one get certified? Is there an exam? Written or Oral? Is there a certification board, what are their qualifications? Does the certification have to be renewed?
Regarding the Florida secret documents case, I don't understand WHY the documents themselves are such a stumbling block.
Why would the jury or defendant need to actually see/read them? The documents were marked in accordance with law and regulation; the government has confirmed they are genuine, and that no record exists of the documents having been DE-classified in accordance with law and regulation. At this point, it seems the actual contents of the documents are irrelevant.
The charges are that Donnie retained classified documents. The court and the jury is not there to determine IF the documents should have been classified. Allowing the defendant to access the documents seems like giving a drug dealer access to the seized evidence so they can try some of the meth (or whatever) and based on how it makes them feel challenge if that was actually what they were selling. "Nah, that's not good crack, I'd never have sold that shit!"
A few things. First, there’s an elaborate statutory scheme that governs how classified docs can be used in court.
Second, he’s not charged with retaining “classified” documents. It would make sense for the Espionage Act and the system for classification to work together, wouldn’t it? But no. The definition for what types of documents he can’t take has a completely different set of questions — like whether they are national defense information — and you can’t prove it by showing it was classified.
A good amount of shade has been thrown at Alvin Bragg, but it looks like his office is the only one that's going to get a jury verdict on Trump anytime soon. Hell, he might even get a conviction.
The dozens is when two guys insult each other, sometimes with "your mama" jokes. It's only semi-serious, more of a challenge than anything else, and often before an audience who are meant to be amused. In Shakespeare's time it was called "flyting".
I'm still annoyed with Fani Willis for showing such lousy judgment, and her lover's (😉) interview didn't help with that. Think the couple of defendants who took plea deals in that case are feeling regretful around now?
I can’t comment on the legal analysis but you guys are underselling the seriousness of this beef. Kendrick isn’t using pedophile as some cheap shot, he 100% believes it’s true. I know a lot of rap beefs are as orchestrated as WWE matches but this one is serious and there have been some pretty credible allegations out there for a while
Actual question: Trump had his attorney ask Stormy Daniels today, “he did very well at that gold tournament [didn’t he]?”
David Waldman looked it up and confirmed Trump did awful: 62nd out of 80 players, averaging over 89 strokes per round. Narrator: Trump did not do well. (62nd out of 80). americancenturychampionship.com/media-center...
How can this be used to impeach Trump’s credibility? Only if he testifies? Not at all? I SO WANT THIS TO BECOME KNOWN.
Did anyone else notice the NY prosecution's argument that Trump knew what the hush money was for because of how he has publicly bragged how he personally signs every check is literally the plot of "Bull" Season 1, Episode 15?
I was surprised to hear Ken describe Stormy Daniels' description of the encounter as "disturbing." A woman acquiesces to sex she doesn't want because the guy is bigger than she is and she's worried about what would happen if she refuses. While this is not good, and in her telling Trump behaved badly, it's pretty normal for women to have at some point acquiesced to unwanted sex because we know things could go very wrong if we refuse. This is reality. This is why I pick the bear—the bear is much more likely than the man to just stay away from me.
Re: the question of which magazine Stormy used to spank Trump... The rumor I heard--and in retrospect it has to be too good to be true--was that the magazine was a copy of People Magazine (or similar) with a picture of his daughter on the cover.
If Drake does think about sueing for defamation he should perhaps consider the recent run of cases out of Australia where various odious dipshits have launched such actions only to be hoist on their own petard.
"made it seem more like sexual assault or rape"… Is rape even a legal term any more? I thought it's just an ugly word that militant feminists use on talk shows.

I love that.

“They might just be a libertarian” 😂😂
I was in a mood.
I live for it

I was expecting a Kenism of "as your lawyer, I would definitely recommend that you not say he is a *certified* pedophile".

People who came here for the "lively comment section".
oooh... is there a State Bar?
Ken,

It's frustrating that retaining more national secrets might work in the dude's favor. If it was just one document we could be much further along.
A good amount of shade has been thrown at Alvin Bragg, but it looks like his office is the only one that's going to get a jury verdict on Trump anytime soon. Hell, he might even get a conviction.
Umm what's the dozens?

If you asked Kendrick or he was making a statement of fact and his lawyers weren’t around he would say yes, I literally believe he abusea minors

Maybe it was an attempt to show she has a poor memory of the event? "Yes" -> he was near the bottom! "No" -> he beat a Super Bowl quarterback!
Did anyone else notice the NY prosecution's argument that Trump knew what the hush money was for because of how he has publicly bragged how he personally signs every check is literally the plot of "Bull" Season 1, Episode 15?

To be fair, I think lots of things we accept are disturbing.
Josh mentioned an indictment against Diddy. Has an indictment been made public?

Well, Laurence, my recommendation would be to watch less daytime TV.
