He'll Be An Old Thug By The Time This Trial Is Over

A Georgia RICO update, more post-immunity decision analysis, and Alec Baldwin

We’ve had some time to digest the Supreme Court decision on immunity, so this week Ken and I talked through the various criminal proceedings involving Donald Trump to discuss how they’ll be impacted. The short answer is: a lot, even the proceedings that mostly have to do with acts before or after he held office. The New York case in particular is likely to get tied up in years of appeals — a process that may be paused if Trump becomes president again.

Meanwhile, Missouri has sued New York, saying the Manhattan DA’s prosecution and associated gag order have deprived Missouri voters of their First Amendment right to hear from political candidates. Since this is a lawsuit between states, the Supreme Court would have original jurisdiction. SCOTUS is unlikely to go for this aggressive theory — not that they need to, given the broad yet vague immunity they’ve already handed Trump.

Alec Baldwin’s trial is starting in New Mexico, but prosecutors will have to deal with some evidentiary problems. The Young Thug case — Fani Willis’s other big, messy RICO prosecution — continues to be stalled; we’ve now seen the transcript of the ex parte conversation defense lawyers were so upset about, and its contents are not good. And in Louisiana, a federal judge will review rapper Baby Gangster’s lyrics, as BG tries to return to work while on supervised release.
