Does a Harris administration look hard at LSFJ Chutkan as a Supreme Court replacement should the time come? She seems to have a serious ability to manage these complex motions and decisions. She's been upheld by the appeals court time and again, with the exception of a couple sent back for further consideration.

Stopping people from building housing is evil? That is true in many cases, especially certain types of housing - in Kansas a town is refusing anything but single family homes- that is an amazingly broad statement. There are certainly a lot of houses that should not be built or rebuilt in flood plains and other locations.

It's possible I missed it but I would have appreciated a note about which lawyers Elon Musk used to sue the commission, as that's generally a giveaway as to his attitude towards it. But that is a minor complaint and otherwise a fine episode, thank you as always

Great episode. Quick note:

When talking about Mark Robinson, Josh mentioned that there was a "Black Hitler SNL character." I'm not sure that's true? I believe that Josh was confusing SNL for TGS, the parody late night show at the heart of 30 Rock.

regarding the California coastal commission: In laguna beach the have refused for years to permit permanent lifeguard towers on some of the beach. A permanent tower would involve one time installation of one conrete piling. Becuase this is not allowed, the city has to drive backhoes across the beach twice a summer to install temporary towers.

Automattic CEO Matt Mullenweg the "benevolent dictator for life" of the open source wordpress project has been picking a fight with a wordpress hosting provider WPEngine that he feels is free-riding on Automattic's hard work. Unfortunately he's been running a very aggressive PR campaign against WPEngine and which has resulted in some alarm from others in the wordpress community.

Does Ken think Automattic will win in a trademark dispute?

How would Josh run the PR campaign differently?

Does Sara have a wordpress blog?

I don't know if Ken was purposely referencing this with his Mark Robinson bit but at some poiny the first headlining black superhero for DC comics was going to be "Black Bomber", a racist white man who turned into a black superhero when under stress. They had two full scripts written up before someone with braincells pointed out how godawful of an idea that was and was able to pitch his own character which became their actual first black headlining hero: Black Lightning.

Trump gets sued for defamation again, this time by the Central Park 5. I'm sure this will be a topic on the show soon enough.

Seems like they have a fairly plausible case to beat any actual malice requirements. Actual damages may not be substantial, but if Trump defends it like with E. Jean Carroll and tries to litigate their underlying guilt and attack whatever judge it goes before, I imagine he could get hit with a pretty big number regardless.
