We hope that you’re enjoying listening to Serious Trouble as much as we’re enjoying recording it (with the exception of the times Josh torments me about RICO.) [Sara adds: Or when Josh and Ken torment me with extended taint-related riffs.]
When we started this podcast, we had planned to mix breaking news episodes with episodes that are deep dives into legal topics that help explain the context behind the controversies, but 2022 has not provided much downtime for the deep dives — the legal cataclysms have been relentless and fascinating. Now that we’re a few months in, we’d like to turn to recording some of those in-depth treatments of legal topics. But which ones?
We’d like to know what you think.
Would you like a whole episode on venue? God, we hope not. [Josh adds: Speak for yourself, Ken.] But how about an episode on hearsay — a legal term that gets used so often, but so few people understand? Or maybe you enjoy hearing me suffer and would like me to record an entire episode about a time that it was RICO [Ken is actually trying to bid Sara down from her proposal for a four-episode series, requested below.]
I don’t think there’s enough for four episodes, but maybe we’ll do this. [Maybe!]
Perhaps you’d like a high-level First Amendment explainer — what are the exceptions, and how do they work? Or perhaps you’d like to walk through a federal criminal case, start to finish, to see how the procedure works.
There are no bad suggestions. Wait… strike that, it sounds too much like a dare. I am confident you can make bad suggestions; do not feel obligated to prove it. Please offer good suggestions.

I'd love to see an episode (or more!) on "how to get out of serious trouble" Basically, for the legally impaired, how to be a good client. This of course would be interspersed with lots of tales of people who were not good clients. you know, talking on TV, not following the lawyers orders on the stand, talking to the feds without a lawyer, and other shenanigans.
I would, no joke, absolutely love a full hour explaining the nitty gritty of federal sentencing.
